What Is Changing
MiCA applies directly in Poland, but the national act that would designate a supervisor is not in force. The Sejm has passed an act on the crypto-asset market three times (26 September 2025, 18 December 2025 and 15 May 2026). The President vetoed each one, and each time the Sejm failed to reach the 3/5 majority needed to override (5 December 2025, 17 April 2026 and 4 September 2026; in the last vote 241 votes, against 266 needed).
According to the KNF, no Polish authority has been designated as MiCA competent authority, so a CASP licence cannot be obtained in Poland. Since 1 July 2026 an entry in the Polish virtual-currency register no longer allows a firm to operate. Crypto services in Poland can now be offered only by firms authorised in another EU state that passport into Poland. ESMA's register lists no CASP with Poland as home member state.
ESMA Interim MiCA Register: Entries by Home Member State
- 379 entries (376 unique LEIs) in ESMA's CASP register
- 0 entries with Poland as home member state
- 185 entries list Poland among the countries where services are provided

- transition ends
The MiCA transitional period (Art. 143(3)) ends. Because no implementing act is in force, no Polish authority, including the KNF, has been designated as competent authority, so CASP authorisations cannot be obtained in Poland.
